How Much Should I Pay Or Receive?

A statutory guideline chart will take into account the number of children, the number of overnights each parent has, the parties’ net incomes, and certain specific expenses of the children (such as childcare, medical and dental insurance premiums, and uncovered medical and dental expenses). Both parents will complete a Child Support Guidelines Worksheet that serves as the starting point for determining child support, as well as a financial affidavit that verifies how much income each parent has. 

Note that Florida courts do not tolerate one parent intentionally quitting a job, not actively looking for a job if they do not have one, or accepting a much lesser-paying job than they are qualified for in order to avoid paying a certain amount of child support. The courts always put the best interests of the children first, so this behavior is not acceptable and may result in the court imputing the income the parent should be earning in making the calculation for child support.

Who Pays Child Support?

It depends – but technically, both! Florida state laws mandate that both divorced parents financially support their child(ren) until they turn 18, or until they graduate high school, if they will graduate before age 19.  

This does not mean that both parents will pay the other parent, but it does mean that both parents will contribute to the child(ren)’s financial needs. Which parent will pay the other, and how much they will pay, will depend on a variety of factors –  there is actually a specific calculation involved! 

What If I Do Not Think The Amount I Am Paying Is Fair?

The amount of child support you will pay, if you are the paying parent, will affect your own financial journey for years to come. Florida’s calculations do not always take into account a family’s unique history or situation, so it is important to have the right legal representation who can stand up for your interests and rights!
