Child Support Attorney Miramar

Child Support

With the rise in inflation, providing for your children financially can be a daunting task. If you are a single parent, or you and your spouse have decided to divorce, you should not have to bear the burden of having sole monetary responsibility for your children. However, you also should not have to pay child support if you are not the parent.

In Florida, children have the right to financial support from both of their legal parents until the age of eighteen, or through high school graduation if they will graduate prior to reaching age 19. The amount of child support paid by each parent will be determined based on the circumstances of the case. To be sure that your children are receiving the appropriate amount of child support from their other parent, or to avoid overpaying in child support, you need dependable representation in your corner.

3 Powerful Steps to Secure Your Future

As a Florida divorce attorney we know your case is different—that’s why we guide you every step, from the first call to the courthouse, staying dedicated to helping individuals and families retain stability.

Meet Your team of Child Support Attorneys Miramar

At Cabanas Law Firm, we pride ourselves in treating each client as an individual, carefully planning for their particular needs and delivering effective legal services to serve their specific legal goals.

How Is Child Support Determined In Florida?

Generally, Florida guideline child support is determined through calculation of the parties’ net incomes and use of a statutory guideline chart based upon the number of children and the number of overnights each parent has with the minor children. Additional expenses, such as medical and dental insurance, childcare, and uncovered medical and dental expenses are added to this guideline support.

If child support is an issue in your divorce or custody (timesharing) case, you will likely be required to file and exchange a financial affidavit that verifies your income and then complete a Child Support Guidelines Worksheet to determine the correct amount.

Modification And Enforcement

Whether you are requesting or fighting against modification, or trying to enforce or defend yourself against child support, our Miramar child support attorneys could protect your rights and fight for your ideal outcome. We believe in ensuring fairness. Just because child support has been arranged does not mean that it is permanent! It is normal for your children to grow, their circumstances to change, and their needs to evolve (and so can yours). It is possible that you or your co-parent may lose your job, gain a promotion, require relocation, or face another major life transition. When you do, the child support paid by one or both parents may need to be adjusted, and either parent has the right to seek such modification in court.

We are aware that some parents may try to avoid their obligation to pay child support in more ways than one. Whether they have quit their job, are not attempting to find work, or are intentionally taking lower-paying positions than they are qualified for, Florida courts strongly oppose this behavior and will punish it accordingly.

If one parent refuses to pay child support altogether, there is a system in place that enforces contribution involving liens against their property and/or income deduction. However, if you are not the child’s parent, or your circumstances have changed, you should not have to pay child support and suffer the negative consequences of enforcement.

How Mediation Can Help

Mediation is a process we strongly recommend to sort out child custody as it allows you and your co-parent to establish the terms of child support together, rather than leaving it in the hands of a judge who may not know your child or understand their needs. By working collaboratively, you could save time and money by staying out of the court and create a plan that is in your children’s best interests.
