One of the most common concerns in any divorce is over alimony, sometimes called spousal support or spousal maintenance. The purpose of alimony is to provide financial backing for a financially disadvantaged spouse during or after the divorce (or both). 

Alimony is not automatic; if both spouses are on equal financial footing, alimony is not necessary or required to be paid by either spouse. Many couples are able to agree on whether or not alimony should be part of their divorce settlement agreement (and if so, how much and for how long), but if couples cannot agree, a judge will look at the facts of their financial situations and make the final ruling.

What You Need To Know About Alimony In Florida – Recent Laws, Types, Time Limits, Amounts, And How A Judge Decides

There is one thing about which you can immediately breathe easier; in July of 2023, Florida ended “permanent periodic alimony,” so no spouse can be forced to pay alimony forever!

Currently, there are 4 different kinds of alimony in Florida, and each has a different limit of duration under Florida law. Our Miramar alimony attorneys can explain which may pertain to your specific situation. 

Temporary alimony

gives a spouse alimony while the divorce is in progress so they can meet necessary expenses. This ends once the divorce is finalized. Although, in a rare case, the court can modify or terminate temporary alimony. 

“Bridge-the-gap” alimony

gives a spouse alimony to meet specific, short-term needs while transitioning after the divorce. This type of alimony can last no longer than two (2) years, and will end sooner if either spouse dies or if the spouse receiving the alimony remarries.

Rehabilitative alimony

gives a spouse alimony with the intent of helping them become completely self-supporting by gaining skills to enter or return to the marketplace. For example, this award may assist a stay-at-home mom with acquiring a college degree or other training to develop employment skills and credentials. This type of alimony can last for a maximum of five years, but depending on the specifics of the rehabilitative plan, the judge may award payments for a set amount of time up to that cap. 

Durational alimony

gives a spouse alimony after the divorce for a set period of time based upon the length of the marriage. This type of award is not permitted in a marriage lasting less than three (3) years. For marriages lasting less than 10 years, durational alimony cannot last longer than 50% of the marriage’s length; for marriages lasting between 10 and 20 years, durational alimony cannot last longer than 60% of the marriage’s length; and for marriages lasting 20 years of more, durational alimony cannot last longer than 75% of the marriage’s length. In exceptional circumstances, a judge can extend the length of durational alimony beyond those percentages upon making written findings of the exceptional circumstances.. 

How much money will be paid in any of these situations will be determined by a variety of factors, but there are some rules around amounts:

  • The alimony award may not leave the paying spouse with significantly less net income than the recipient has
  • Durational alimony may not be more than either the recipient’s “reasonable need” or 35% of the difference between the spouses’ net incomes – whichever is less

If the matter of alimony goes before a judge, here are some of the factors they may consider when deciding on the type and amount to award (and they may award more than one type of alimony):

  • A spouse’s need for financial support
  • The other spouse’s ability to pay financial support
  • How long the marriage lasted
  • The standard of living both spouses had during the marriage
  • Both spouses’ anticipated financial needs during and after divorce
  • The age of both spouses
  • The physical, mental, and emotional conditions of both spouses (including any disabilities)
  • The resources and incomes of both spouses
  • The earning abilities and employability of the spouse seeking support
  • Each spouse’s contributions to their marriage and family life (child-rearing, helping build the other spouse’s career, etc.)
  • Each spouse’s future responsibilities for children and child support
  • Whether or not adultery was a cause of the divorce
  • And more.
