Navigate Your Divorce with Confidence
One of the most common concerns in any divorce is over alimony, sometimes called spousal support or spousal maintenance. The purpose of alimony is to provide financial backing for a financially disadvantaged spouse during or after the divorce (or both).
Alimony is not automatic; if both spouses are on equal financial footing, alimony is not necessary or required to be paid by either spouse. Many couples are able to agree on whether or not alimony should be part of their divorce settlement agreement (and if so, how much and for how long), but if couples cannot agree, a judge will look at the facts of their financial situations and make the final ruling.
If you are the primary earner in the relationship, you may be losing sleep over how much alimony you will end up paying your spouse. Can you afford what will be ordered? Does your spouse deserve the amount ordered? How long will you have to have the cost of your divorce hanging over your head? When do you get to start fresh?
If your spouse is the one who will likely be paying you alimony, you may be also worried about him or her trying to minimize the amount he or she will pay you. What if you struggle financially as a result?
When there is a lot at stake, financially speaking, in a divorce, having a legal team you trust on your side is absolutely essential. You should be represented by attorneys who are familiar with the local courts and the latest alimony law updates, and who can guide you toward your ideal outcome. While our Miramar alimony attorneys can lead you through collaborative negotiation or mediation with your spouse, and will attempt to prioritize a path through divorce that minimizes fighting, cost, and stress, we understand that sometimes the alimony issue (and other divorce issues) have to be persuasively presented in court. We are willing and able to stand up for your rights in front of a judge!
Do not risk receiving less alimony than you deserve, or overpaying your spouse; do not navigate this complex legal process on your own. Contact the team at Divorce & Mediation Law Firm | Cabanas Law Firm today to request your free 15 minute case evaluation. We look forward to hearing from you soon!
What Our Clients Think of Cabanas Law Firm
Would recommend this firm to friends. I engaged them to handle making an adjustment to my divorce settlement agreement. As it was likely to cost less than the retainer in this case, they kindly agreed to refund any remaining money. They handled everything perfectly and professionally, and I’ve just received a check with the remaining funds. Thank you Cabanas

What You Need To Know About Alimony In Florida – Recent Laws, Types, Time Limits, Amounts, And How A Judge Decides
There is one thing about which you can immediately breathe easier; in July of 2023, Florida ended “permanent periodic alimony,” so no spouse can be forced to pay alimony forever!
Currently, there are 4 different kinds of alimony in Florida, and each has a different limit of duration under Florida law. Our Miramar alimony attorneys can explain which may pertain to your specific situation.
gives a spouse alimony while the divorce is in progress so they can meet necessary expenses. This ends once the divorce is finalized. Although, in a rare case, the court can modify or terminate temporary alimony.
“Bridge-the-gap” alimony
gives a spouse alimony to meet specific, short-term needs while transitioning after the divorce. This type of alimony can last no longer than two (2) years, and will end sooner if either spouse dies or if the spouse receiving the alimony remarries.
Rehabilitative alimony
gives a spouse alimony with the intent of helping them become completely self-supporting by gaining skills to enter or return to the marketplace. For example, this award may assist a stay-at-home mom with acquiring a college degree or other training to develop employment skills and credentials. This type of alimony can last for a maximum of five years, but depending on the specifics of the rehabilitative plan, the judge may award payments for a set amount of time up to that cap.
Durational alimony
gives a spouse alimony after the divorce for a set period of time based upon the length of the marriage. This type of award is not permitted in a marriage lasting less than three (3) years. For marriages lasting less than 10 years, durational alimony cannot last longer than 50% of the marriage’s length; for marriages lasting between 10 and 20 years, durational alimony cannot last longer than 60% of the marriage’s length; and for marriages lasting 20 years of more, durational alimony cannot last longer than 75% of the marriage’s length. In exceptional circumstances, a judge can extend the length of durational alimony beyond those percentages upon making written findings of the exceptional circumstances..
How much money will be paid in any of these situations will be determined by a variety of factors, but there are some rules around amounts:
If the matter of alimony goes before a judge, here are some of the factors they may consider when deciding on the type and amount to award (and they may award more than one type of alimony):
We understand you may be feeling confused, overwhelmed, angry, sad (or all of the above), and that you may be unsure of your next steps. Our firm can help you move forward with confidence.
