How Does Mediation Work In Florida?

You, your spouse, and your attorneys (if you choose to have them, which is highly recommended) will meet with a neutral mediator to open the lines of communication and directly discuss all of your settlement options. This person is a facilitator of compromise, who does not represent either party. Everything said during mediation is confidential! During mediation, you will address the various aspects of your divorce, including the division of assets and debts (who gets what and who will pay for what), alimony (spousal support), retirement earnings to be considered or divided, a parenting plan (if you have minor children, what the arrangements will be) and more. The goal of mediation is to find solutions that are agreeable to both parties. If the session(s) succeed, your mediated settlement agreement will be filed with your case, and then you can take your next steps to get the agreement approved and your divorce finalized.

Do You Need Attorneys For Mediation?

You are not required by law to have an attorney representing you in mediation, and some people believe that they can work out their terms without attorneys present. It is important to understand that in this scenario, mediators are neutral third parties who cannot give legal advice, and they cannot look out specifically for your interests! Their job is to keep the peace and get an agreement on the table by whatever means possible.

Conversely, you are permitted to have an attorney present at mediation and consult with them at any time. An attorney can give you legal advice, and is looking out for you, not your spouse. This means that an attorney can advise you as to if you are making a bad deal or if you are getting taken advantage of.
