Under Florida law, both parents are required to financially support their children until they turn 18 (in most cases) or graduation from high school so long as the child will graduate before reaching the age of 19. The state uses a statutory guideline chart to determine how much child support each parent will pay. Amounts are calculated based on factors like:
To verify that the basis for child support is accurate, both parents fill out their Financial Affidavits to determine their net income in accordance with Florida law. The parties’ net incomes form the basis for the child support guideline calculation.
The benefits of mediation in child support cases
If you can work with your spouse to reach a compromise and agree on the amount of child support each parent will pay, this can save you time, money, and stress. We highly recommend mediation – meeting with a neutra lthird-party legal professional who can facilitate compromise between you and your co-parent.
Mediation is confidential and if a settlement is reached, it will be binding and ratified by the Court in a final judgment. If no settlement is reached, you can still litgitate. However, the primary benefit of mediation when it comes to child support is that it allows you and your co-parent to decide what is right for your family, as opposed to leaving the decision in the hands of a judge who is essentially a stranger to you.

If the other parent is not paying child support, contact our attorneys immediately. Your child has a legal right to financial support, and we can use all of the legal resources at our disposal to get that support. This may include filing a motion for enforcement with the court, modifying the existing agreement, and more. The court can garnish wages or even arrest your co-parent in order to enforce the order.
Consequences of contempt can start as soon as you miss even one payment – that is how seriously the court takes child support. Typically, this begins with a Motion for Contempt, but it can quickly evolve to wage garnishment, suspension of your license, and more. If you are honestly worried about not being able to make payments, it could be that the court has placed too high of a burden on you or that your circumstances have changed and warrant a modification. Rather than missing payments, it is in your best interests to contact an attorney before legal penalties start so you can fix the issue.
While it is intended to cover the child’s needs for food, clothing, housing, education, and healthcare, the parent receiving child support has discretion on how to allocate the funds for the child’s benefit; He or she does not have to provide receipts or proof of how the funds are being used.
