Understanding Time-Sharing And Parental Responsibility In Florida

“Time-sharing” is a legal term that refers to the amount of time a child spends with each parent, and “parental responsibility” refers to the allocation of decision-making authority each parent has.

In Florida, courts now (as of new changes to the law in 2023) operate with the presumption that 50/50 custody – shared time-sharing and shared parental responsibility – are in the best interests of the children, unless proven otherwise. The courts want both parents involved!

We can also assist you with child support issues – if you are worried you may be required to pay more child support than is fair, or that your ex will not pay child support you and your child are due, you can trust us to pursue fairness and make sure your children have what they need and deserve!

There are a few different ways that time-sharing and parental responsibility can be divided:

Majority time-sharing (the children live with one parent the majority of the time, and with the other parent some of the time, or the other parent may have visitation rights)

Equal time-sharing (it may not be exactly 50/50, but both parents get generally the same amount of time with the children)

Supervised time-sharing (in cases where there is abuse, neglect, or substance abuse issues that can lead to child endangerment, supervised visitation may be the right option)

Sole parental responsibility (one parent has the decision-making authority for things like education, healthcare, religion, etc.

Shared parental responsibility (both parents share decision-making authority)

Shared parental responsibility with ultimate decision-making authority (both parents share decision-making authority, but one parent has tie-breaking power)

3 Powerful Steps to Secure Your Future

As a Florida divorce lawyer we know your case is different—that’s why we guide you every step, from the first call to the courthouse, staying dedicated to helping individuals and families retain stability.

Meet Your team of Davie Child Custody lawyers

At Cabanas Law Firm, we pride ourselves in treating each client as an individual, carefully planning for their particular needs and delivering effective legal services to serve their specific legal goals.

Why Trust Our Firm To Help You And Your Children?

Our team is well-versed in the emotional and legal complexities of custody (which, in Florida law, is referred to as “time-sharing” and “parental responsibility”). Our approach to your case is focused on your child and on you! We want to help you create a parenting plan that meets the unique needs of your family and sets you up for future success and stability.

To do this, we do not believe that fighting is always necessary! Our Davie custody attorneys use strategies that minimize conflict and facilitate collaboration, when possible. It is better for your kids, it is better for you, and it is often more cost-effective and more quickly resolved when non-adversarial means of conflict resolution are used the right way! Of course, we are more than capable of aggressively advocating for you and your children in cases where settlement is not possible.

Here are a few other reasons to choose our firm!

Our Attorneys Are Certified Mediators

We have extensive familiarity with mediation – it’s in our name! Mediation is when you and your co-parent meet with a neutral third-party professional who works to help you resolve the issues in your custody case. Mediators cannot give you legal advice, and whatever agreement you reach in mediation is not legally binding until there is a court order. You can choose to have an attorney represent you in mediation in order to advise you and protect your interests. Because we are certified mediators, we can serve in the position of mediator OR as your attorney, whichever you choose!

We Take Complex And Difficult Cases

All custody cases are challenging, but if yours involves a blended family, multiple children with different needs, parents in different states, abuse, or another complex situation, we can assist you because we have likely handled cases similar to yours before! No matter how high-conflict your case is, you can count on us!

We Are Highly Responsive

You should not go for days without a reply from your attorney or feel like you are not in the loop when it comes to your case; we will do our best to be accessible to you!

We Are Bilingual

Language should never be a barrier, especially when the legal complexities of divorce can already feel overwhelming. Our bilingual legal team ensures that you can communicate comfortably and understand everything clearly, so you can make confident, informed decisions.

Frequently Asked Questions About Custody In Davie, Florida

What is a parenting plan?

A parenting plan is the document you will submit to the court which outlines how you and your ex will work together to raise your shared children, and includes a detailed time-sharing schedule, as well as the allocation of parental responsibility.

The state of Florida highly encourages mediation in custody disputes; some courts may

require this. Additionally, mediation allows you to save time and money, while maintaining agency over your custody decisions. Refusing to at least attempt mediation (barring instances of domestic abuse or violence) is not in your best interests, or your children’s.

Our goal is always to keep you and your children out of court, if possible. If there are instances when your children will need to speak to a judge, such as about their wishes, everyone involved will endeavor to make it as stress-free as possible for them, but we can advise you as to your other options.

No, your spouse cannot legally prevent you from seeing your children without a court order. In Florida, both parents typically have a right to time-sharing with their children unless the court determines that visitation is not in the best interest of the child, such as in cases involving abuse or neglect. If your spouse is attempting to restrict your access without a valid legal reason, we can help you take the necessary steps to protect your rights and ensure a fair time-sharing arrangement.
