In Florida, time-sharing is the amount of time that the child physically spends with each parent, inclusive of overnights, while parental responsibility refers to the amount of decision-making power each parent has over the child’s life (such as their medical care, education, religious upbringing, etc.).
Florida family courts operate under a statutory 50/50 custody presumption, meaning that equal (or as close to equal as practically possible) time-sharing and equal parental responsibility are presumed to be in the child’s best interests unless one side can present strong evidence against the other to prove the contrary.
If there is a dispute over how time-sharing and parental responsibility should be divided, the case may need to go before a judge, who will consider many factors before making their final decision, including:
The emotional ties of the child to each parent
The ties of a child to their community (school, church, friends, sports teams, etc.)
The ability of each parent to provide a safe, loving environment for the child
