In the state of Florida, alimony is a legal obligation that’s imposed by the court on one spouse to pay the other spouse financial support after marital separation or divorce. The courts will evaluate several different factors, like the duration of the marriage, earning capacities, standard of living, contributions to the marriage – both financial and nonfinancial – age and health, marital misconduct, debts, and more. However, the two main factors they’ll focus on are the financial need of the dependent spouse and the other spouse’s ability to pay that amount, and the other factor is the length of the marriage. Alimony is now based on a statutory calculation that uses the parties’ net monthly incomes and the length of the marriage.
Under the new Florida alimony reform statute, a marriage of less than 10 years is a short-term marriage, a marriage of 10+ to just under 20 years is a mid-length marriage, and a marriage of 20+ years is a long-term marriage. Permanent alimony has been eliminated in the state of Florida.
One thing to remember is that alimony may be modifiable, depending on the facts of your case. For example, your alimony can be increased or decreased based on a change in circumstances that was permanent or involuntary under appropriate circumstances.
