Alimony can be a major point of contention in a Florida divorce. It is meant to provide a financially disadvantaged spouse with financial support during and/or after the divorce. However, it does not play a role in all Florida divorces; if the spouses are on similar financial grounds, alimony will not be necessary or required to be paid by either spouse.

Recent Changes To Florida’s Alimony Laws You Should Know About
In 2023, SB1416 was signed into law and introduced changes to important aspects about how alimony in Florida is determined. The bill eliminated permanent alimony, established a 5-year cap on rehabilitative alimony, as well as caps on durational alimony in each of the tiers of marriage length.
Furthermore, it also eliminated durational alimony in a marriage lasting under three-years. Previously, any of those types of alimony could have been awarded. Now, there are only 3 types of alimony: bridge-the-gap, rehabilitative (now limited to 5 years), and durational alimony.
This type of alimony provides financial support to a spouse to meet specific, short-term needs while transitioning after the divorce. It can last no longer than two (2) years and will end sooner if either spouse dies or if the spouse receiving the alimony remarries.
Rehabilitative alimony
This arrangement provides financial support to a spouse
with the intent of helping them become entirely independent by obtaining skills to enter or return to the workforce. It can last for as long as five years, but depending on the specifics of the rehabilitative plan, the judge may award payments for a set amount of time up to that cap.
Durational alimony
This type of alimony gives a spouse financial support for a set period of time following the divorce, based on the length of the marriage. It is not applicable to marriages lasting less than three years. For marriages lasting less than 10 years, durational alimony cannot last longer than 50% of the marriage’s length; for marriages lasting between 10 and 20 years, durational alimony cannot last longer than 60% of the marriage’s length; and for marriages lasting 20 years of more, durational alimony cannot last longer than 75% of the marriage’s length.
