Hello and welcome to 60 Seconds with Sergio. I am your host, Sergio Cabanas, Attorney-at-Law here in Florida. Thank you for joining me today.
So, today’s question is: “Sergio, I’ve already decided to move forward with a divorce.” “How do I start the process?”
Well, naturally, I would recommend that the process start with you consulting an experienced attorney.
Why?
Because an experienced attorney can review the specific facts of your case and determine the potential issues that can come up.
When you stop and think about the actual divorce process itself, it basically involves 3 important factors. The first factor, of course, is money.
You’ve heard the old saying, ‘money makes the world go round’, it also makes the divorce go round. So, the issues involving money in a divorce basically involves identifying the marital assets then accounting for any disappearing of these marital assets, and making sure that these assets are ultimately distributed in a fair and equitable way between the spouses once the divorce is finalized.
The second issue that is involved in a divorce process are the minor children. In the event there are any minor children, we would address such issues as parental responsibility, and time sharing or what’s otherwise known as custody.
The third issue involved in a divorce, of course, is determination of the legal marriage. So, now that we’ve addressed the potential issues that could be involved in your divorce case, now you can take the right step forward: meeting with an experienced attorney who can review the specific facts of your case to determine the best outcome for you.
So you can see how important, at least from an attorney’s perspective, how ideal it is to start the divorce process by preparing for it first then filing the divorce, whenever is possible, and making the process go much smoother and maximizing the benefits for you.
This often involves obtaining, for example, financial records, such as tax returns, pay stubs, bank’s statement, and so on.
Well, I hope this short video provided at least some guidance over an important issue relating to divorce law. Of course, this is not a substitute for an actual consultation with an attorney of your choice, who can review the specifics of your case and maximize the benefit for you.
Thank you again for joining me. As always, stay informed and stay strong.
