Just how is child support calculated? What are the factors involved in calculating child support?

Hi. I’m Sergio Cabanas, Managing Attorney of the Divorce & Mediation Law Firm. Thank you for joining me today.

Today’s question is: Sergio, how is child support calculated and what are the factors involved in computing child support payments? The law considers that the right to child support is a legal right that actually belongs to the child. Therefore, neither parent can waive child support, even if they wanted to.

So, whenever there is a divorce case or a paternity case involving minor children, judges are required to make extra sure that the calculation for child support is made correctly in every case.

The calculation for child support starts with the amount of overnight time-sharing that each parent has with the child. The idea is that the more time the parent spends with the child the more expenses that parent is likely to incur for the benefit of the child. Such as meals, school supplies, diapers, medicine, etc. You get the idea. The other parent, in theory, should help contribute to these expenses.

So, the more time one parent spends with the child, the more child support he or she may receive for the child. Conversely, the more time one parent spends with the child, the less child support that parent would have to pay for the child.

The second consideration is the amount of income each of the parents earns and their ability to contribute towards the child support. Just keep in mind that when it comes to calculating child support there could be other factors that come into play. Such as whether one of the parents is paying for childcare, and/or health insurance for the child.

Finally, the person paying child support often asks if it’s possible to restrict how the other parent spends the child support payments. Such as compelling or making sure receipts are provided. Or invoices, or some other proof of payments to prove that the funds are being used exclusively for the child. However, there is no legal requirement that forces the parent to provide this information if he or she refuses to do so.

So, as you can see, the general idea on how to calculate child support is simple enough in theory. But when you add in all the factors involved, it can get a little complicated. So if you find yourself having to deal with child support payments and calculations, whether you’re the one receiving or the one paying the child support, please, contact us today to make sure it’s done right.

I hope this short video provided you with at least some guidance on child support calculations. Thank you again for joining me today. As as always: Stay informed so you can stay strong.

hello and welcome to 60 seconds with Sergio I am your host Sergio cabanas attorney-at-law president owner and founder of the cabanas law firm thank you for joining me today how is child-support calculated often a very touchy subject what happens is that there’s generally two important factors that the courts look at in determining child support first is the amount of time sharing each spouse is to have with the children for example the parent that has more time sharing would likely incur more expenses on behalf of the child versus the other parent who is spending very little time with the child the parent that’s spending the more time would be entitled to more of the child support than the parent that does not the other factor of course are the relative incomes of the parties and all of this information the time sharing arrangement plus the incomes of the parties is put into a computer system that lawyers use that would then automatically calculate the child support that one or the other spouses to pay the other pursuant to these general guidelines so whenever in doubt consult an attorney who can then properly calculate these things for you again assuming you determine what the time sharing arrangement will be and the relative incomes of both parties in a divorce thank you for watching 60 seconds with Sergio please remember that the purpose of these videos is to provide some general guidance over some commonly asked important areas of the law that are often complex even for our attorneys so there’s no substitute for you to personally meet with an attorney on a one-on-one consultation who can review all of the information of your case and explain how the specific laws apply in your case thank you for watching and good luck.
