Experience

The Firm Pompano Beach Families Have Turned to More Than 10,000 Times

Numbers don’t decide a family law case, but they tell you whether a firm has seen a situation like yours before. Known across Florida as The Divorce Lawyers, Cabanas Law Firm has helped more than 10,000 people through divorce and family law matters, earned over 1,000 reviews across our locations, and built a team with more than a century of combined attorney experience. Whatever your case looks like, we’ve almost certainly handled one like it — and from our Pompano Beach office, we know how these matters move through the Broward courts.

Founder Sergio Cabanas is a Florida Supreme Court Certified Mediator, and the firm keeps board-certified mediators on staff — which matters more than it might sound, because in Florida most family cases are meant to be resolved, not won.

The Goal Is Resolution, Not a War

There’s a myth that hiring a family law attorney means declaring war. In practice, the opposite is usually true. A good family lawyer’s job is to shrink the conflict — to settle everything that can be settled and reserve the fight for the few things that genuinely need one. That isn’t just easier on you emotionally; it’s usually faster and less expensive, and it tends to produce agreements that actually hold, because both sides had a hand in them.

It also matters for your children, when children are involved: the tone you set during a case often becomes the tone of your co-parenting after it. We litigate hard when a case calls for it. But we start from the premise that the best outcome is one you can live with, reached with as little damage as possible.

Mediation

How Mediation Actually Works in a Florida Family Case

Most family disputes in Florida settle before trial, and mediation is where much of that happens. It’s worth understanding, because people often picture the wrong thing.

How the Sessions Run

In mediation, the people involved in the dispute — with their attorneys, if they have them — meet with an independent, impartial mediator whose job is to help resolve the case without further litigation. It usually isn’t a face-to-face negotiation across a table. More often the mediator meets with each side separately, walks through the facts and the issues, and carries settlement ideas, offers, and counteroffers back and forth. That structure lets each side think and speak candidly without the other in the room.

Why Confidentiality Matters

The reason it works is confidentiality. Mediation communications are protected, which means both sides can float settlement ideas without fear those discussions will later be used against them in court. That protection is what lets people move off their opening positions and actually reach agreement.

Certified Mediators on Staff

Because the mediator’s role is so central, working with a firm that has certified mediators on staff is an advantage. We can represent you through mediation as your advocate, or serve as a neutral third-party mediator — either way, keeping the case on a structured path toward an agreement both sides can accept.

Not Ready to File

When Staying Married — For Now — Is the Right Call

Not every couple in trouble is ready to file for divorce, and Florida gives them room to wait. A postnuptial agreement lets spouses settle, in advance, how assets, debts, and potentially alimony would be handled if they later divorce — without filing now. Couples delay for all sorts of reasons: the hope of reconciliation, wanting to wait until the children are older, immigration considerations, financial timing. Resolving the money questions early tends to make any later divorce smoother, because the hardest part is already done.

Florida Has No "Legal Separation"

One clarification we give often: Florida does not recognize “legal separation” as a formal legal status. You’re either married or divorced — there’s no court-supervised in-between. Spouses can absolutely separate in practice (living apart, dividing finances), and a postnuptial agreement can put those financial terms in writing. But a postnup has to be done right to hold up: lawful, fair terms; full financial disclosure unless properly waived; and independent counsel for each spouse unless properly waived. A generic online form often isn’t worth the paper it’s printed on.

FAQ

Frequently Asked Questions

Does hiring a family lawyer mean my case is headed for court?

Does hiring a family lawyer mean my case is headed for court?

No — usually the opposite. Most family cases settle, and much of our work is resolving what can be resolved without litigation, saving trial for the issues that truly need it.

What is mediation, and are those talks confidential?

Mediation is a settlement-focused process with a neutral mediator who typically shuttles offers between separately-seated sides. Communications are protected by confidentiality, which is what lets both sides negotiate openly.

Is mediation required in Florida?

Florida strongly channels family cases toward mediation before trial, and most cases settle at or before it. Having attorneys and certified mediators who use the process well makes a real difference.

Does Florida have legal separation?

No. You’re either married or divorced. But you can separate in practice, and a postnuptial agreement can address finances while you stay married.

Can a postnuptial agreement help if we're not ready to divorce?

Yes — it can settle how assets, debts, and potentially alimony would be handled later, giving you clarity while you decide whether to move forward.

Can one attorney represent both spouses?

No. Spouses are opposing parties even in agreement, so each needs their own counsel, or one side proceeds without.
