How Paternity Works In Florida

In Florida, if a couple is married and has a child, the mother’s husband is the child’s legal father and natural guardian. If the mother is not married, paternity can be established in one of three ways. 

1. By Marriage

If unwed parents marry, the father will automatically become the legal father, thus gaining all of the rights and responsibilities associated with that role. This is only necessary to gain parental rights if the father was not included on the birth certificate and/or no acknowledgment of paternity was filed by the state. 

2. By Voluntary Acknowledgement 

Both the mother and alleged father sign a “Voluntary Acknowledgement of Paternity” form. After 60 days, paternity is established and therefore cannot be revoked, unless it is proven that fraud or another extreme circumstance took place. 

3. Through A Court Process (usually involving DNA evidence) 

A child’s mother, alleged father, or legal representative, as well as the Florida Department of Child Support Services, can begin this process.
