Attorney for Time-Sharing/Parent Responsibility in Broward and Miami-Dade County

What is Timesharing?
Time-Sharing/Parent Responsibility
Dividing time-sharing and parental responsibility is the most challenging component of ending a marriage. You are used to having your children with you all the time, and it is hard to imagine deviating from that. Unfortunately, the surge of emotions can get in the way of creating a fair and reasonable agreement that’s in the best interest of your child.
Our time-sharing/parent responsibility attorneys are well-versed in the emotional and legal complexities of these situations and can support you through the process. We take a child-centric approach to custody cases while also protecting our client’s interests. Contact us today to discuss creating a parenting plan via negotiation, mediation, or litigation.
Options for Time-Sharing and Parental Responsibility
There are three options each for time-sharing and parental responsibility. You can pursue:
- Sole parental responsibility
- Shared parental responsibility
- Shared parental responsibility with ultimate responsibility
- Majority time-sharing
- Equal time-sharing
- Supervised time-sharing
Our time-sharing/parent responsibility attorneys are also certified mediators and can help you reach an agreement outside of court. However, we will also prepare to litigate the case in front of a judge if needed.

Types Of Time-sharing In Florida
Time-sharing is the legal term for the amount of time the child spends with each parent. Majority time-sharing is the most common and means the child will spend the majority of overnights with one parent. If your parenting agreement awards you majority time-sharing, you will be your child’s primary residential parent.
If you want to divide the time evenly, you can work toward an equal time-sharing agreement. You have numerous options for this, including a week on and a week off. A time-sharing/parent responsibility attorney can also help you work out a creative agreement that fits into both of your schedules.
Finally, your situation might qualify for supervised time-sharing. If granted, a third party will supervise visits between the child and noncustodial parent. If the child’s other parent has a history of substance abuse, domestic violence, or child abuse, this might be the right option for your family.
Types Of Parental Responsibility Agreements
Parental responsibility gives the parent legal authority to make decisions on behalf of the child. Parents commonly share parental responsibility, meaning they work together when making decisions. However, shared parental responsibility with ultimate decision-making authority is also an option. If this is part of your parenting plan, you and your former spouse will discuss all major decisions. However, the person with ultimate authority will have the power to make the final decision regarding the matters outlined in the parenting plan.
While not as common as the other two, you might be granted sole parental responsibility, giving you complete authority to make decisions without conferring with the other party. Sole custody is most likely if a parent has a history of substance abuse, mental health issues, domestic violence, child abuse, or other problems that impact his or her ability to care for the child.
Advantages Of Mediation When Creating Parenting Plans
Many former couples choose mediation when determining time-sharing and parental responsibilities. A third-party mediator will discuss the areas of agreement and disagreement before exploring solutions. This is non-adversarial and non-binding, meaning you do not have to agree to anything. However, if you come to an agreement, the mediator can prepare it and submit it to the court for final approval. Our time-sharing/parent responsibility attorneys are also certified mediators and can assist you if you would like to pursue this option.
Modifying A Parenting Plan
If you have experienced a significant change in circumstances, your current parenting plan might not meet the needs of your child. Thus, you can take steps to modify time-sharing, parental responsibilities, or both. Our time-sharing/parent responsibility attorneys can help you explore modifications through mediation or litigation. First, though, it is important to determine if you qualify for a modification. Contact our firm to learn more about modifying a parenting agreement.
