Cabanas Law Firm helps clients reach desirable child custody agreements through mediation, negotiation, and litigation.
Child Custody Agreements
While few people have an “easy” divorce, it is more complicated when sharing children. Then you have to set up a child custody agreement that designates time-sharing and parental responsibility. As much as you want to keep your children with you full time, you know they need access to both parents. At the same time, you are likely having trouble negotiating it because of the emotions involved.
Our child custody attorneys take a child-centric approach when helping clients create agreements. At the same time, we will protect your interests and rights while helping you deal with difficult emotions. We offer non-adversarial strategies, including mediation, but can also present evidence before a judge if necessary. Contact us today to begin working out a child custody agreement that is reasonable, fair, and in the best interests of your children.
Options for Time-Sharing and Parental Responsibility
Our child custody attorneys can help you pursue:

Time-sharing And Parental Responsibility
As certified mediators and seasoned litigators, we can assist you in creating a child custody agreement in or out of court. In both cases, your agreement will designate time-sharing and parental responsibility.
When creating a time-sharing agreement, you can choose between majority, equal, or supervised time-sharing. With majority-time sharing, one parent will have the child at least 50.1 percent of the time. That person will be the primary residential parent. On the other hand, you will split overnights down the middle if you choose equal time-sharing. Finally, supervised time-sharing is used when one parent poses a danger or threat, meaning he or she cannot be alone with the child without a third-party present.
Our child custody attorneys can also help create an agreement for decision-making authority, referred to as parental responsibility. Most agreements include shared parental responsibility, although one parent can have ultimate decision-making authority for some situations. Finally, sole parental responsibility is an option if the other parent poses a risk to the child. For instance, this might be appropriate if one parent has a history of drug or family abuse.
Enforcing Child Custody Agreements In Weston, Fl
Parents are required to remain in compliance after entering into a court-approved custody arrangement. Our child custody attorneys can assist with compliance issues if the other party is keeping you away from your children.
Our firm can file an enforcement order if the other parent violates the time-sharing agreement. Then the judge can take action, such as sentencing the parent to jail and modifying the parenting plan to give you more time-sharing responsibilities.
Contact our firm today to discuss various enforcement actions. With quick action, you can reunite with your child soon.
Relocation And Child Custody In Weston, Fl
Florida law prohibits the custodial parent from moving more than 50 miles from the address listed on the parenting plan without permission. While short trips are allowed, court approval is required if the parent stays in the new location for 60 consecutive days. Our child custody attorneys can assist parents on both sides of this issue. If you want to relocate, we can help you negotiate an agreement with the other parent before requesting court approval. We can also file a motion with the court for a hearing if the other parent does not want you to relocate. On the other hand, we can help you present evidence to prevent the move from occurring. Time is of the essence with relocation cases, so contact our firm to discuss your situation.
Child Preference
The court is open to considering child preference when deemed mature and intelligent enough to make such a decision. While most states require that children reach a specific age before weighing in, that is not the case in Florida. However, the court normally only considers the preference when the child is at least 11 years old.
While judges consider child preference in some cases, it is only one factor that goes into creating a child custody arrangement. Thus, a child can state he or she prefers to live with one parent, but the judge can still determine that equal time-sharing is the right choice for the situation. Contact our child custody attorneys to learn more about child preference.
